Presentation of the subject

Maritime law regulates the framework in which maritime traffic activities are registered.

 

With the entry into force of the Maritime Navigation Law (Law 14/2014, of July 24), a wide-ranging reform of Spanish maritime law is carried out that is coordinated with International Maritime Law and the practice of Maritime Transport.

 

The contents of the program have as the axis of the discipline the shipowner or shipowner, and the ship as an instrument for the exercise of an economic activity organized in the form of a company. 

The contracts on the exploitation of the ship, the risks of navigation, the subjects and organizations in charge of establishing the regulatory framework for the maritime transport sector, are aspects addressed by the agenda that will conclude with references to the specialties of maritime rescue and security.

 

TecnoCampus will make available to teachers and students the digital tools necessary to be able to carry out the subject, as well as guides and recommendations that facilitate adaptation to the non-face-to-face modality.

Conformity with REGULATION (EC) no 1071/2009 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of October 21, 2009

In accordance with REGULATION (EC) No. 1071/2009 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of October 21, 2009, which establishes the common rules relating to the conditions that must be met for the exercise of the profession of road transporter, this subject complies with the provisions of Annex I, within the following contents:

B. Elements of commercial law

The applicant must, in particular, in relation to the transport of goods and passengers by road:

  1. know the conditions and formalities required to carry out commercial activities and the general obligations of merchants (registration, books of commerce, etc.), as well as the consequences of bankruptcy;
  2. have adequate knowledge of the different forms of commercial companies, as well as the rules relating to their constitution and operation.

 

Activities and evaluation system

The evaluation of the subject will be composed of the average between the grade obtained in the exam and the continuous evaluation provided that each of them
is equal to or greater than 5 about 10.


Calculation for obtaining the relevant grade:


60% of the grade will be obtained from the final exam which will include test-type questions and/or some questions to be developed. It is necessary to obtain a minimum grade of 5 about 10 to average with the other grades of continuous evaluation of each quarter.


40% grade of follow-up cumulative evaluation composed of:


1.- carrying out practical cases and questionnaires: preparation prior to correction outside class and/or evaluation and correction in class. Legal search and legal terminology preparation outside class and correction by the teacher.

RECOVERY EXAMINATION in case of suspending the subject, only the part corresponding to the final exam can be recovered, keeping the note of the activities developed during the course of the approved practical parts. The minimum score for the recovery test will be 5 about 10.


A student who has not appeared in the first call CANNOT appear in recovery.

Any form of academic fraud will be sanctioned according to the center's evaluation regulations. In the event that signs of fraud are detected, including the improper use of artificial generative intelligence tools, the teaching staff of the subject may summon the student to an individual interview with the objective of verifying his authorship.
